‘She lied under oath,’ lawyer contends

Brown tells the judge he has compiled a list of 82 points that Formenton made to the detective in 2018 that were corroborated by at least one witness, sometimes multiple witnesses.

His client did get one thing wrong, about who was in Room 209 at what point, but that is more a timeline note than getting things wrong, Brown adds.

When it comes to E.M., he argues, “She didn’t just get things wrong. She lied under oath.”

He cites examples of when, he argues, E.M. lied while testifying — one was her saying she weighed 120 pounds, when she knew her medical records said she was 128 pounds; another was when she said she slipped and fell in front of McLeod.

“You can’t rely on what she says under oath,” Brown tells the judge.

He contends E.M. also lied about how often she goes to Jack’s bar for dollar beers. She testified she’d only been there on a few occasions, but changed her story when told her friend would say they went there often.

Brown says E.M. also testified she was disoriented and didn’t know where she was at the end of the night and she wasn’t really familiar with the Delta hotel, but was confronted with the fact it was her favourite place to go for brunch.

“She is not being candid with the court in her testimony … [She is] intentionally dishonest,” the lawyer argues.
